Another lawsuit seeks to derail Lago casino

The legal action continues to pile up against a proposed Finger Lakes casino as a citizens group backed by gambling competitors filed another lawsuit this week about the $425 million project.

Casino Free Tyre has filed an Article 78 lawsuit against the Tyre Town Board and Thomas Wilmot, the Rochester-area developer and owner of the proposed Lago Casino & Resort.

The lawsuit submitted Nov. 2 in Seneca County court seeks “to vacate and nullify” environmental approvals given to the project by local officials after an appeals court ruled that the town erred in the initial environmental review.

“The Town of Tyre Negative Declaration ignores the fact that we are talking about a massive, Las Vegas-style casino that will forever change the character of our small rural town,” the group said in a statement.

The project recently received a second round of local approvals to resume construction of the casino just off the state Thruway at exit 41.
